Abstract

The traffic accident is an unexpected and unintentional event involving a vehicle with or without another road user resulting in human casualties and / or property losses. The demand for foreign citizens is the application of the legal system in Indonesia which does not distinguish the perpetrators in cases of traffic accidents. Formal legality and tend to override a sense of justice in society. Settlement of traffic accident resolutions can be taken, namely the judicial process and outside the judicial process using Alternative Dispute Resolution (ADR) in the form of mediation. The formulation of the problem raised in this research is whether the basis for the implementation of ADR in the settlement of traffic accident cases involving foreign citizens and how the implementation of ADR in resolving traffic accident cases involving foreign nationals in the jurisdiction of Badung Police Station. This type of research is empirical legal research, namely by making observations / observations directly on the object of research on the implementation of ADR in the settlement of traffic accident cases involving foreign nationals. This research uses a legal sociology approach, namely analyzing how the reactions and interactions that occur when the norm system works in society with the problem in this scientific paper is the implementation of ADR in resolving cases of traffic accidents of foreign citizens. The conclusion of this research is the basis for implementing alternative dispute resolution stipulated in Article 235 of the LLAJ Law. The regulations regarding the settlement of traffic crime cases are based on the Regulation of the Chief of the National Police No. 15 of 2013. The police have the authority to take the pattern of resolving legal issues through Alternative Dispute Resolution (ADR) based on the National Police Chief Letter No: B / 3022 / XII / 2009 / SDEOPS on 14 December 2009. ADR carried out by the Badung Police Traffic Unit in the settlement of cases of traffic accidents involving foreign nationals in the form of mediation. Mediation is carried out by investigators handling cases as facilitators and mediators.
