JURIDICAL REVIEW OF LEGAL PROTECTION OF BUSINESSES WHO EXPERIENCE LOSSES FROM CONSUMER BAD FAITH
Abstrak
Overall economic development and growth, especially in the national industrial and
trade sectors have produced various types of goods and services that can be
consumed in addition, globalization and free trade supported by advances in
telecommunications and information technology have enabled the flow of
transactions of various goods and services, both made domestically and abroad.
Law No. 8 of 1999 concerning Consumer Protection regulates consumer obligations
in Article 5 letter b, namely that violators have good intentions to carry out the
business of purchasing goods and / or services. Currently, losses are often
experienced by business actors because they are caused by the failure to fulfill the
achievements that should be carried out by consumers which cause losses to
business actors, including bringing food from outside the business premises of the
business actor, where the business actor has notified prospective consumers that
the products sold are halal products but there are still bad intentions of consumers
who bring non-halal products causing losses to business actors. This type of
research is normative legal research which is a scientific research procedure to find
the truth based on scientific logic from a normative perspective. The approach is
legislation, the formulation of the problem What are the legal consequences of good
faith of business actors against consumer losses? and how is the legal protection for
companies that suffer losses due to bad faith of consumers? The conclusion is that
the legal consequences of good faith of business actors against consumer losses
can be seen in the basis of the responsibility of business actors to provide
compensation expressly stated in Article 19 paragraph (1) of Law No. 8 of 1999
concerning Consumer Protection which states that business actors are responsible
for providing compensation for damage, pollution and/or consumer losses due to
consuming goods and/or services produced or traded. Legal protection for business
actors who suffer losses due to bad faith of consumers, namely the importance of
legal protection for business actors, acts that are protective and/or provide
assistance to sufferers whose rights are seized or harmed.
